[ARCHIVED] Ordinance No. 815 Salary of City Assessor

CITY OF TRENTON

ORDINANCE NO.  815

AN ORDINANCE TO AMEND SECTION 2-61 OF THE TRENTON CITY CODE ENTITLED "SALARY OF CITY ASSESSOR" TO SET FORTH COMPENSATION AND BENEFITS PAID BY THE CITY. 

THE CITY OF TRENTON, COUNTY OF WAYNE ORDAINS AS FOLLOWS:

Section 1. Section 2-61 of the Trenton City Code entitled "Salary of City Assessor" shall be amended and which will read as follows:

Sec. 2-61.   Salary of City Assessor.

(a)  Pursuant to the authority of Chapter IV, section 4.7(d) of the City Charter, the City Council does hereby increase the annual salary of the City Assessor to eighty one thousand three hundred seventy dollars ($81,370.00) per year effective upon election certification November 2023.  In addition, on July 1, 2024, the salary shall increase and/or decrease and shall mirror those increases and/or decreases provided to other non-union City of Trenton employees, effective on the 1st day of July, 2024, 2025, 2026 and 2027. 

(b)  i) The applicable level as set forth, which shall be dependent upon the Assessor’s certification level as determined by the state assessor’s board.  MAAO Level 3 in State Assessment Administration shall receive 100 percent of the stated salary.

(c)   ii) MCAO Level 2 in State Assessment Administration shall receive 85 percent of the stated salary.

(d)  iii) MCAT Level 1 in State Assessment Administration shall receive 75 percent of the stated salary.

(e)  iv) A non-certified municipal assessor shall receive 65 percent of the stated salary.

(f)   In addition, the fringe benefits of health, prescriptive drug, dental and optical insurance coverages, which are subject to periodic adjustment, and shall mirror those provided to other non-union City of Trenton employees, incorporating equivalent benefit levels, co-payments, deductibles and premium sharing, and excepting residency incentives; as well as a group life insurance policy rounded to the nearest One Thousand Dollars ($1,000.00) of salary, including accidental death and dismemberment during their term of office, shall be paid for the City Assessor.  The City Assessor may elect supplemental life insurance through the city's group insurance carrier subject to the provisions of the insurance company, but the cost of the supplemental coverage must be paid by the assessor.  

(g)  A city assessor employed as a City of Trenton employee before July 1, 2012, with five (5) years of continuous service shall receive five hundred dollars ($500.00) and an additional fifty dollars ($50.00) for each year of service thereafter, payable of the payroll cycle following the employee’s anniversary date.

(h)  The prescribed levels shall become effective as of the date set forth in the above schedules.

(i)   The City Assessor's salary level shall initially be fixed in accordance with his/her certification level as of the commencement of the next term of office, and   periodically adjusted during the term of office in accordance with the current salary schedule and any changes in certification levels of the Assessor by the state assessors’ board.

Section 2. Saving Clause.  Nothing in this Ordinance or in the Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.

Section 3. Severability.  Should any word, sentence, phrase or any portion of this Ordinance be held in a manner invalid by any court of competent jurisdiction or by any state agency having authority to do so for any reason whatsoever, such holdings shall be construed and limited to such work, sentence, phrase or any portion of the Ordinance held to be so invalid shall not be construed as affecting the validity of any of the remaining words, sentences, phrases or portions of this Ordinance.

Section 4. Conflicting Ordinances.  All prior existing ordinances adopted by the City of Trenton inconsistent or in conflict with the provisions of this Ordinance are, to the extent of such conflict or inconsistency, hereby expressly repealed.

Section 5. Readings.  This Ordinance shall be given a first reading on June 20, 2023, shall be enacted on July 5, 2023, and shall be effective November 13, 2023.

ADOPTED, APPROVED AND PASSED by the City Council of the City of Trenton this 5th day of July, 2023.
