ORDINANCE NO. 705-20

AN ORDINANCE TO AMEND THE TRENTON CITY ZONING MAP, BEING CHAPTER 110, OF THE CITY CODE, BY ADDING A NEW SUBSECTION (c) TO SECTION 110-53, ENTITLED ZONING DISTRICT BOUNDARIES, TO REMOVE 4 PARCELS FROM THE RT TWO FAMILY RESIDENTIAL DISTRICT AND INCLUDE THE 4 PARCELS IN THE EXISTING AND ADJACENT B-3 DISTRICT.

THE CITY OF TRENTON ORDAINS:

Section 1. Section 110-53 entitled Zoning district boundaries shall be amended to add a new subsection (c) which shall then read as follows:

Section 110-53 Zoning District Boundaries

a) The boundaries of the zoning districts are hereby established as shown on the zoning map of the City of Trenton, a copy of which is attached hereto and made a part thereof. The official zoning map and copies of the map are on file at the office of the building department, which map with all notations, references, and other information show thereon shall be as much a part of this chapter as if fully described herein.
b) Parcel numbers 82-54-014-03-0256-000 through 82-54-014-03-0264-000 located in the City, are rezoned from Business B-3 to R-4 Residential, and shall be so designated on the City's official zoning map which is attached hereto and incorporated by reference.
c) Lots 4, 5, 6, & 7, Teifer's Fort Street Subdivision, north side of Theodore Street, described as 24B4 LOT 4, LOT 5, LOT 6, LOT 7 TEIFERS FORT ST. SUB T4S R10E, L55 P73 WCR, are hereby rezoned from RT Two-Family Residential to B-3 General Business.

Section 2. Savings Clause. Nothing in this Ordinance or in the Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.

Section 3. Severability. Should any word, sentence, phrase or any portion of this Ordinance be held in a manner invalid by any court of competent jurisdiction or by any state agency having authority to do so for any reason whatsoever, such holdings shall be construed and limited to such work, sentence, phrase or any portion of the Ordinance held to be so invalid shall not be construed as affecting the validity of any of the remaining words, sentences, phrases or portions of this Ordinance.

Section 4. Conflicting Ordinances. All prior existing ordinances adopted by the City of Trenton inconsistent or in conflict with the provisions of this Ordinance are, to the extent of such conflict or inconsistency, hereby expressly repealed.

Section 5. Readings. This Ordinance shall be given a first reading on September 18, 2017, shall be enacted on October 2, 2017, and shall be published on or before October 9, 2017, and shall be effective October 10, 2017.
